Halloween and Christmas are approaching, and foreign consumers are about to start their holiday carnival. Due to the impact of the epidemic, the number of outdoor gatherings and parties will be relatively reduced, but this does not hinder the enthusiasm of foreign buyers, and interior decorations have ushered in hot sales.
This year, products related to Halloween and Christmas have occupied the hot search list for a long time, among which women's clothing products account for a large proportion on the hot search list, followed by decorative inflatable balloons and door hangings. However, behind the hot sales of decorations, there are also hidden risks of infringement. Figure 1
Generally speaking, products with holiday elements do not have as high a risk of infringement as ordinary popular products, but some decoration brands have also filed complaints against similar products. Recently, there have been complaints about Halloween door hangings and Christmas doll decorations. Figure 2
The complainant is EverBloomingOriginal. Although the elements of its decorations, such as skulls, ghosts and pumpkins, are very common, the brand still filed a complaint. It is reported that some stores are suspected of infringement for selling Christmas elf dolls. In addition to the above products, some wooden carvings with Halloween and Christmas elements are also on the infringement risk list. From this point of view, even products with common elements have a relatively high risk of infringement.
This year, infringement cases have become more frequent, and major brands have become more aware of their rights. From electronic products (earphones, charging cables, mobile phone holders) to household items (furniture leg covers, lamps), to ordinary words, magazines, toys, etc., in many cases, even the sellers themselves may not be able to figure out why a good product has infringed.
According to the survey, the main types of infringement are trademark, patent, copyright and image infringement. If we analyze the infringement issues, we will find that on the one hand, the brand has increased its protection of patents and trademarks, and on the other hand, some sellers are lucky and eager to succeed.
The arrival of the peak season is an opportunity for sellers to make a lot of money. However, if sales are hindered due to infringement, it is really not worth it. Sellers need to act cautiously and prudently. Christmas Decorations Infringement |
