With the popularity of cross-border e-commerce, infringements caused by trademarks and patents are happening almost every day, which is the first pitfall of cross-border e-commerce. Therefore, many sellers attach great importance to the registration of trademarks abroad.

 

The USPTO is "broken"

 

The United States Patent and Trademark Office (USPTO) is facing tremendous pressure as the backlog of applied trademarks exceeds 900,000 for the first time.

 

 

Although the United States Patent and Trademark Office had previously issued an emergency notice on the delay of trademark registration, this did not affect everyone's enthusiasm for applying for trademarks.

 

As the number of trademark applications has increased significantly, the waiting time for trademark applicants has also increased significantly. Many people have not received their registration applications after seven or eight months of application. In addition to the constraints of insufficient manpower, various malicious and illegal applications and identity theft information have further slowed down the review speed of the Patent and Trademark Office staff.

 

Although USPTO staff also stated that they will take a number of measures to improve work efficiency, even they themselves are unsure whether they can change the current situation.

 

Chinese sellers "add fuel to the flames"

 

The number of applications received by the USPTO each quarter has nearly doubled since 2018 .

 

All of this, to a certain extent, is inseparable from the "fueling" of Chinese sellers !

Over the past few years, the USPTO has experienced a massive increase in trademark applications, a large portion of which have come from China. An April data report showed that 38.47% of trademark applications received by the USPTO in the fourth quarter of 2020 came from China.

 

The US Patent and Trademark Office also believes that the increase in demand for US trademark registrations is inseparable from the significant growth of the e-commerce industry. As Chinese sellers occupy half of Amazon's market share, they do have some responsibility for this .

 

As the trademark application time continues to be extended, we should remind you that there are many people who register trademarks with impure motives and malicious intent, which is a typical example.

 

However, in view of the recent well-known "malicious registration of TWS complaints against peers" in the cross-border circles of Europe and Japan , the editor still recommends that sellers who have not yet registered their trademarks apply for registration as soon as possible to avoid being haunted by evil spirits.
