Amazon sued Shenzhen seller for maliciously complaining about infringement of competing products

Recently, Amazon publicly filed a lawsuit against three sellers because they submitted thousands of infringement complaints to their competitors through Amazon's complaint system in an attempt to increase their own product sales.

 

In a statement released this week, Amazon said the lawsuits were the latest in its crackdown on unscrupulous sellers.

 

According to the indictment, these unscrupulous sellers did not just file complaints and wait and see. They even created many fake websites and uploaded some pictures collected from Amazon stores on them, hoping to use these things as evidence.



Amazon accused one of the sellers, saying the seller joined Amazon's Brand Registry program through a "false" trademark application.

 

Amazon said the U.S. Trademark Office had canceled the seller's trademark application, but the seller still used it to participate in Amazon's Brand Registry program.

 

It is understood that the trademark application was submitted by a Shenzhen intellectual property company. The lawsuit shows that the US Trademark Office has punished the company for submitting more than 15,800 trademark applications using false, fictitious or fraudulent residence information and /or credentials.

 

Amazon said that this case was the largest infringement complaint case in recent years, and these sellers submitted more than 4,000 complaints in total. The lawsuit shows that only a small number of these complaints were successful in the end, and Amazon helped them remove the products of competing sellers.

 

Amazon's original intention in launching the infringement complaint system was to protect the legitimate rights and interests of sellers. For example, when someone sells T-shirts with Mickey Mouse on them on Amazon , Disney has a legal way to file a complaint because it owns the copyright to the character (so far).

 

However, this system may be exploited by people with ulterior motives to attack competing products and increase sales of their own products.

 

Amazon currently has no good solution to this problem and can only increase its review efforts on the existing basis.

 

However, if this lawsuit is successful, it will surely serve as a deterrent to those sellers who want to maliciously attack their peers.
