Infringement case of hot-selling products in the US market occurred, and 209 stores were sued!

Recently, there was another highly-watched infringement case in the US market, with a total of 209 stores being sued.

 

It is reported that a company named ACUSHNET COMPANY and SCOTT CAMERON GOLF DESIGN, INC. filed an infringement lawsuit in the Southern District Court of Florida, USA , with case number 22-cv-061051. The products in the lawsuit are golf -related products with trademarks such as Titleist, Footjoy, and Pinnacle .


 

The plaintiff in this case is ACUSHNET COMPANY , whose main product is golf equipment. Titleist is one of the company's main brands, and it also has sub-brands such as Footjoy, Pinnacle, KJUS, and Vokey Design .

 

On Amazon, Titleist 's most popular golf ball product has received nearly 7,000 reviews, 92% of which are five-star reviews. Most consumers gave positive reviews because the product is stable and feels good, while the main reasons for negative reviews are incorrect color labeling and damage to the packaging during transportation . Despite this, the product's sales are still very high .

 

It should be noted that the brand has registered the corresponding trademarks, patents and copyrights . The fact that 209 stores were sued this time also serves as a reminder to sellers to avoid infringement.

 

Sellers of related products cannot use the Titleist, Footjoy, and Pinnacle trademarks in their listings . Product images are also copyrighted , which is a "red line" that sellers cannot cross .

 

It is understood that the plaintiff in this case has applied for a TRO ( emergency temporary injunction ) and some stores have been frozen .

 

On July 19 , the plaintiff served the judicial documents via email, and the defendant seller needs to entrust an American lawyer to submit a reply or motion within 21 days , otherwise the plaintiff has the right to apply for a default judgment from the court after 21 days .

 

In this case, the defendants are mainly stores operated on platforms such as Amazon, AliExpress, eBay , and independent websites , many of which are Chinese sellers. This also sounded a wake-up call for Chinese sellers. In addition to mainstream e-commerce platforms, they must also avoid infringing products when operating independent websites.

 

The foreign market has very strict supervision on copyright, because once infringement occurs, it will have a very serious impact on the store. Therefore, when sellers select products on a daily basis , they must conduct patent and trademark searches, otherwise the product will be removed from the shelves due to infringement, which will not be worth the loss.
