According to information disclosed on Amazon's official website, Amazon's counterfeit crime department CCU and BMW Group recently won a joint civil lawsuit.
The indictments were filed against four Spanish sellers who attempted to sell counterfeit BMW accessories, including valve covers, badges and key rings, through Amazon in Europe.
With a complete chain of evidence, the Alicante EU Trademark Court ruled that these bad actors had violated the law, infringed the BMW Group's registered trademarks, and also violated Amazon's platform policies.
According to Amazon, the platform has always taken proactive measures to prevent counterfeit goods from entering consumers' shopping lists and has been monitoring stores on the platform.
In this case, Amazon used advanced machine learning tools to detect suspicious activity and then, with the assistance of the BMW Group, confirmed the authenticity of the products in question.
After discovering the problematic products and stores, Amazon forced the counterfeiters to close their sales accounts, deleted the infringing listings related to the case, and refunded the affected customers. Amazon CCU then worked with BMW to file a joint lawsuit against the counterfeiters. Amazon's CCU department was set up to identify and destroy counterfeit organizations . Kebharu Smith, director of the department , said that Amazon has zero tolerance for counterfeit and shoddy goods and will crack down on all bad actors on the platform.
This ruling is a significant victory, and by working with brand owners like BMW, the company has been able to successfully combat counterfeiters and prevent counterfeit goods from reaching the hands of platform users and being sold elsewhere.
Data shows that Amazon uses a large number of automatic protection systems to prevent counterfeit goods from entering the platform. In 2022 alone, these systems blocked more than 800,000 attempts by counterfeiters to open new accounts, and more than 99% of suspected fraudulent or counterfeit listings were blocked or deleted by the platform.
Amazon also works closely with brands and law enforcement around the world to hold bad actors accountable. In 2022, Amazon's CCU prosecuted or referred more than 1,300 criminals for investigation in the United States, the United Kingdom, the European Union, and China.
Regarding this joint action, Jochen Volkmer, head of trademarks and designs at the BMW Group , said that when Amazon and BMW work together to identify and combat counterfeiters with their respective investigative capabilities, experience, and technology, the effectiveness of the action will be significantly increased; the BMW Group is also proud of its achievements so far in protecting customers from bad actors.
