Amazon and Etsy sellers risk misusing images

Overseas countries have been cracking down on various infringements, but in addition to the most basic trademark rights, copyrights and various patent rights, portrait rights cannot be touched, especially some celebrity posters, which need to be avoided. Recently, Amazon, Etsy and other platforms have had their products removed from the shelves due to infringement of portrait rights.

 

The person whose portrait rights were infringed was named Tristyn Bailey . She was a 13-year-old cheerleader who was killed near her home in May this year. The suspect was her 14-year-old classmate who is currently awaiting trial for murder. This case has also attracted a lot of attention.

 

However, the local investigative agency I-TEAM received a report that a third-party seller on Amazon was selling posters featuring Tristyn Bailey on the platform , with prices ranging from $12 to $35 depending on the size .

 

I-TEAM contacted Tristyn Bailey 's family and was told that this was not an isolated case. Sellers on Etsy also engaged in this behavior, selling T-shirts with Tristyn Bailey's name printed on them, and "Her fight is my fight" was written on them for $21. And no authorization was obtained, and the proceeds would not be donated to the foundation under Tristyn Bailey's name.

Bailey 's family said that Bailey 's name can always be used to remember him and to draw attention to the safety of young people, but it is absolutely unacceptable to use it for personal gain. I-TEAM also helped them defend their rights.

 

An Etsy representative responded that the company does not comment on specific pages or listings, but the family can report online violations related to publicity rights, name rights and image rights. Bailey's family did so, and the Etsy product listing was subsequently removed. After contacting Amazon, the seller's product was also removed for violating intellectual property policies.

 

The seller may want to use Bailey 's name to alert more people, or he may simply want to make a profit. In any case, the unauthorized use of other people's portraits constitutes infringement, especially celebrity posters. The seller cannot afford to take advantage of this kind of popularity.

 

Sellers must also strictly abide by the platform requirements, refrain from infringing on their rights, and promptly safeguard their rights if their rights are infringed. It is not a wise move to seek short-term gains and make "quick money".
