Five major brands filed infringement lawsuits involving up to 100 trademarks

These five brands have different functional focuses, but they all have a certain degree of popularity, which has led some sellers to try to use the brand's trademarks to attract buyers' attention.

 

In order to safeguard their own rights and interests, the five major brands initiated an infringement lawsuit on August 12, with the case number 21-cv-4308, involving as many as 100 trademarks.

It should be emphasized that the OAKLEY circle trademark can easily be misused by manufacturers on places such as glasses legs, which also poses a risk of infringement.

 

 

In addition, a closer look will reveal that it includes not only eyewear trademarks, but also clothing trademarks such as FLAK JACKET. This is because as the brands grow, many companies have developed from eyewear brands to comprehensive brands involved in clothing, footwear and accessories.

 

Therefore, in response to this infringement case, not only sellers of glasses need to pay attention, but sellers of other products also need to pay attention to whether they have touched the red line of the above-mentioned trademarks, and promptly check whether these trademarks appear on the product surface and listing.

 

In fact, this is not the first time that these five brands have filed infringement lawsuits. According to incomplete statistics, Costa Del Mar has filed five infringement lawsuits from May last year to January this year. In addition, R RAY-BAN and OAKLEY filed 14 infringement lawsuits between February last year and July this year.

 

Since these brands are subsidiaries of EssilorLuxottica, the world's largest eyewear group, they often file lawsuits jointly.

 

In addition to the brands mentioned in this article, EssilorLuxottica also owns many other brands. Judging from the above data, this eyewear group files lawsuits very frequently, so it is not ruled out that more brands will initiate rights protection lawsuits.
