According to foreign media reports, this year approximately 157.2 million people in the United States will shop online and offline on the last weekend before Christmas.

 

For sellers, the Christmas sale is undoubtedly a good time to boost sales, but along with the opportunity, there are also risks that cannot be ignored.

 

On Christmas Eve, many Christmas products were recalled

 

The first and foremost issue is product safety and quality. Recently, several Christmas-themed products have been recalled by relevant agencies due to dangerous factors.

 

The first one is the Wireless Decorative Tree Light Controllers produced by Mr. Christmas LLC , which was recalled by the U.S. Consumer Product Safety Commission ( CPSC ) . The number of recalled products reached 44,600 .

It is reported that this product can turn on the decorative lights on the Christmas tree through wireless operation. The controller consists of two parts, one is a switch that can be used for operation, and the other is a separate white receiver.

 

The product will be sold in online and offline channels of Walmart, Target and CrackerBarrel between July and November 2024, with a price range of US$25 to US$40.

 

The controller sold at Walmart and Cracker Barrel is designed to look like a mint candy in green, red and white colors with a candy cane-shaped switch. It is labeled "Christmas Light Controller." The controller sold at Target under the Wondershop™ brand looks like a square switch box decorated with green, red and white balls and printed with the words "Tree Light Switch." The white wireless receiver that plugs into the socket is printed with "Mr. Christmas" and one of three model numbers: 39611, 39612, 39630.

 

The reason for this recall is that the receiver part may cause a fire hazard due to overheating. The company has received 10 reports of overheating, one of which caused a fire, but no injuries have been reported so far.

 

Another product that the UK Office of Product Safety and Standards ( OPSS) announced a recall of is a Christmas cottage-shaped candlestick , which also poses a risk of fire .

The base of the candle holder is a round wooden board with two Christmas-style log cabins on it, and next to it is a glass container for candles. The glass container is located right below the Christmas cabin, so if consumers use it for a long time or frequently, the log cabin decoration may catch fire.

 

The materials of the hut and base may further burn, causing a fire. Therefore, this product does not comply with the requirements of the UK General Product Safety Regulations 2005. Currently, sales channels The Range and Wilko have announced a recall.

 

The Range and Wilko have also been recalled by OPSS for gingerbread man-shaped cushions, penguin - shaped cushions and reindeer- shaped cushions . The pompoms and bows on the gingerbread man-shaped cushions are at risk of falling off, while the seams of the penguin-shaped and reindeer -shaped cushions are prone to tearing , which may cause the filling to be pulled out . These accessories and fillings may cause suffocation risks to infants and young children , so they are recalled .

The recall of the above products is currently in progress. Both CPSC and OPSS remind consumers to place the products in a safe place and return the products to the seller as soon as possible to obtain a refund.

 

In addition to the United States and the United Kingdom, Kmart's "Mr & Mrs Claus Reversible" and "Christmas Elf Reversible" Christmas series bedding products in Australia were also urgently recalled across Australia due to the presence of chemical residues. It is reported that many consumers reported that they smelled gasoline on the products and subsequently experienced symptoms such as dizziness.

 

Infringement is also a serious problem, and some copyright holders have initiated rights protection

 

When sales soar, in addition to product safety, intellectual property rights should not be ignored. This is also where small and medium-sized sellers are prone to "stepping on thunder". Last Christmas, some popular products with more than 10,000 reviews were put on the brand's TRO temporary ban list because of sellers' infringement, causing them a lot of losses.

 

Before Christmas this year, copyright holders also launched rights protection actions.

 

The first case is the protection of the rights of Lisa Medford, an artist from Texas, for her Christmas Rooster Wreath . According to the information, the lawsuit was filed at the end of last month, and the case number is 24-cv-12251 . Lisa Medford is good at combining traditional elements with holiday elements, so her works are also widely praised. The Christmas Rooster Wreath that she is defending is a seasonal handmade artwork designed for Christmas.

 

It is reported that the copyright number of the rooster wreath is VA 2-420-850 , which was issued in November this year . Lisa Medford has filed a lawsuit in the Northern District of Illinois, USA , and applied for a TRO motion (temporary restraining order). According to the meeting minutes on December 10, the TRO has not yet been approved.

Another rights protection lawsuit was also initiated in Illinois, USA. It was a rights protection case of artist Randy Wollenmann, and the reason for the lawsuit was also copyright infringement.

 

Randy Wollenmann is an illustrator , designer and artist , whose works are known for their rich colors and unique compositions. Randy Wollenmann's copyright protection this time is mainly aimed at 5 Jesus and Christmas illustrations . The copyright numbers of these works are VA 2-404-453, VA 2-404-454, VA 2-403-372, VA 2-404-452 and VA 2-404-360 . The copyright applications for these works were approved in July this year.

 

In addition to the two cases mentioned above, various lamps with Christmas elements and Christmas tree-related products are also the hardest hit areas for infringement at this time.

 

Lighting is an excellent product for creating an atmosphere. This year , many lighting fixtures with Christmas elements have passed patent applications, including Christmas Tree Light, Glowing Christmas Tree Light and LED Christmas light.
