Compared with simple infringement accusations, what is more troublesome for sellers in the industry is the infringement claims targeted by "rogue law firms"!
GBC, Keith , EPS, SMG , HSP, David ... These are the "rogue law firms" that have long been criticized by sellers in the cross-border circle . In forums and other places where many sellers gather, there are such voices: " Once you are targeted by these law firms, it is impossible not to bleed ."
Recently, another seller has suffered from this.
In March, one of the stores owned by seller Jason was complained by GBC for trademark infringement. During the negotiation stage, GBC asked for a settlement of US$40,000.
Jason said, "The two products in the store are newly developed. It's not easy to launch new products this year. I finally found two good ones. They were spotted less than a month after they were put on the shelves."
It is reported that the two listings involved were put on the shelves at the end of February this year, and only sold more than 100 orders in total. However, in mid-March, the two listings were successively accused of infringement and were subsequently removed from Amazon.
During the listing period, the total sales of the two listings was $3,700.
Currently, Jason's store has been frozen. For more than two months, the two sides have not reached an agreement on the settlement amount being too high. Therefore, Jason said, " The offer is too high, the negotiation is time-consuming and energy-consuming, and the passive feeling is too unpleasant. I would rather give up the store . "
In fact, there are many cross-border sellers who have experiences like Jason.
Not long ago, a Walmart seller of Frisbee products was sued by Keith for trademark infringement, and the other party demanded compensation of $10,000. However, the seller's store had only listed the product and had not yet generated actual sales. After being complained about, the platform froze $6,500 of its store funds. In the end, the seller paid $4,000 to resolve the complaint.
Another seller was sued by both GBC and Keith law firms within two months, and spent nearly $40,000 in total to reach a successful settlement.
On social media platforms, many sellers have had the painful experience of being “sucked dry” by rogue law firms. “I don’t want to pay this money, but I have to pay it for the sake of survival. It’s so unpleasant!”
According to industry insiders, infringement claims are the "fat meat" business in the cross-border circle, so more and more people are starting this business.
Previously, Yien.com reported that "a small domestic team of four people made 25 million yuan a year by handling infringement claims." At the same time, there are also people who specialize in cross-border infringement claims training, which really proves the seller's saying that "only those without conscience can make big money."
"It is difficult for a fly to bite an egg that has no cracks," so sellers must do a good job of intellectual property work before listing products. This can greatly reduce the probability of being targeted by rogue law firms. Even if there is a copyright loophole, the early intellectual property work can help reduce the settlement money.
