A: Usually when a client’s account is frozen after being sued, the plaintiff’s law firm will ask the platform to provide your account funds through the court. For example, if the amount is 3,000 US dollars at the time, the plaintiff’s law firm will then settle based on this amount. Subsequent deposits and withdrawals will generally not be used as a reference for settlement.

Some customers have tried to switch to Paypal to receive payments, but this is not safe and there is a high possibility that the account will be frozen later. Therefore, we usually advise customers not to continue operating before obtaining a settlement agreement to avoid more unnecessary losses. In addition, for the AliExpress platform, only the amount frozen at the time will be provided, and the subsequent operating income will not be considered. Q: What is the settlement process?

A:

1. If you want to negotiate a settlement with the plaintiff, we will send you a word document. Please fill in the information first and we will send it to an American lawyer after it is sorted out. The lawyer will help you negotiate the settlement with the plaintiff's law firm.

2. Later, the plaintiff's law firm will provide information about your store's infringing products and a settlement agreement based on your information. In the settlement agreement, the plaintiff's law firm will propose a settlement amount that they believe is reasonable.

3. After you receive the settlement agreement, if you agree to the settlement, you will sign the settlement agreement. After paying the attorney's fee, the attorney will send the signed settlement agreement to the plaintiff's law firm. The plaintiff's law firm will send the signed settlement agreement to the platform and apply for deduction. After the settlement money is deducted from the account, the plaintiff will request a withdrawal of the lawsuit. The plaintiff will send the withdrawal to the platform and the platform will arrange to unfreeze the account.


Q: How long does it usually take to get a reply after filling in the information?

Q: After the settlement, how long will it take for my account to be restored?

If it is a Paypal account and there is enough settlement money in the account to be deducted, the account can usually be unfrozen in about a month.

If it is an AliExpress, Wish, or Amazon account, it will be slower. Usually, it will take one or two months for the plaintiff to apply for a deduction and for the platform to deduct the money. After the deduction, the plaintiff will send a notice of unfreezing to the platform. It usually takes another 2-3 weeks for AliExpress and Wish platforms to unfreeze the account, and the Amazon platform will take even longer. These are all specific operations of the platform and the plaintiff cannot control them.

A: If the platform cooperates every time and immediately deducts the funds in the platform to the plaintiff after receiving the settlement agreement, then the efficiency of the plaintiff's law firm will be very high, and they will have more and more cases against this platform. The result is that more platform sellers will be frozen, and the interests of the platform will eventually be harmed. Therefore, the platform will usually use various reasons to delay the deduction of funds to the law firm for a long time, and the process for the plaintiff to get the money will be very long. Q: What is your fee schedule? Are there any additional charges?

Service fee charging standards:

If the frozen funds in your account are less than 4,000 USD, 2,000 RMB will be charged;

If the frozen funds are higher than USD 4,000, we will charge 20% of the funds we help you recover, with a minimum of RMB 2,000, that is: service fee = (frozen funds - settlement money) * 20%, with a minimum of RMB 2,000.


Q: What will happen if I don’t reconcile later?

A: Failure to reach a settlement does not mean that the case will be withdrawn. The plaintiff's law firm can file a second lawsuit, and your account will no longer be able to be used normally. It may also be subject to additional freezing or related freezing at a later date, which is quite troublesome.

If it is a Paypal account, if there is no settlement later, all the funds in the account will be deducted to the plaintiff, and the case will not be considered settled. If a settlement is reached later, an additional settlement fee will be required.


Q: How much settlement money do I usually need?

A: Each law firm is located in a different state and represents different brands, so the settlement situation is also different: (Special note: The following is only a statistical data based on the high probability of cases handled in the past, and does not represent the settlement amount of all cases. There are definitely exceptions)

GBC: Usually the settlement is based on the balance of frozen funds. Regardless of the sales volume of your infringing products, 80%-90% of the frozen amount is generally required. For frozen funds below $2,000, $2,000 is usually required as a settlement. Usually the GBC settlement is rounded to 500 or 1,000.

EPS: The settlement is based on the number of infringing products sold. If you didn’t sell any, the settlement is usually around $5,000. If you sold dozens or hundreds of them, they’ll want tens or hundreds of thousands of dollars to settle. So if you sold a lot and were caught by EPS, it would be very difficult to settle.

KEITH: For settlement based on the frozen amount, they have a minimum settlement requirement for each store. For example, if there are two stores and each store is deducted $10, they usually require $1,000 for each store to settle. If the deducted amount is large, they usually require about 60% or even more. Relatively speaking, Keith's cases are easier to settle.
