It is reported that the company was established in 2014 and is a cross-border e-commerce company located in Shenzhen. Its products are sold on multiple e-commerce platforms.

 

In the "Announcement on Strict Implementation of Overtime System" issued by the company, clear requirements were made for employees in operation and development positions: from September 1 to December 31, 2022, employees must work overtime for 30 hours per month, and will be given a meal allowance of up to 20 yuan if they work overtime until 8 or 9 p.m. every day. If employees work less than 30 hours of overtime, they will be required to donate 300 yuan to the company.

 

In addition, the company requires employees to provide a screenshot of their clock-in time that night + order details to the cashier as the basis for weekly reimbursement.

 

However, on a certain recruitment software, the company's regulations are contrary to the above practices, clearly stating that employees do not have to work overtime, can apply for compensatory leave if they work overtime, and there is no mandatory overtime requirement. When a media outlet asked the company to verify the authenticity of the incident, the company said that the incident was true, but it was an internal company matter.

 

 

For a time, there were many different opinions. Most netizens condemned the company involved, saying sarcastically: "I owe money after working; is the company a disaster-stricken unit? It still needs employees to donate to the poor; I worked for a month and owed the boss thousands of yuan."

 

Of course, some netizens have also questioned whether such a legal person has the ability to operate a company independent of Chinese law?

 

Some netizens even complained that they had the same experience: "Many cross-border e-commerce companies in Shenzhen require 30-50 hours of overtime per month, and it is linked to performance. If the overtime hours are not enough, wages will still be deducted."

 

Judging from the company's practice, it has violated the relevant provisions of Chinese law. Chinese law clearly stipulates that overtime work needs to be negotiated with employees, and under the condition of voluntary participation by employees, the overtime hours shall not exceed the relevant provisions of the law, and the company shall pay overtime wages to employees in accordance with relevant national regulations.

 

At the same time, the company's behavior of forcing employees to work overtime is not an internal business matter, but has implications for whether the rights of workers are protected. Forcing employees to work overtime through donations does not comply with the requirements of relevant laws.

Some operators said that even if they have finished their work, there will still be a lot of reports waiting for them, such as daily reports, weekly reports, monthly reports, annual reports, advertising analysis, profit analysis ... These reports are endless, and if they cannot be finished during working hours, they will have to work overtime.
