SHEIN is sued again for alleged infringement

According to foreign media reports, the well-known American fashion brand Stussy recently filed a lawsuit against SHEIN in the California Federal Court.

 


Stussy claimed that SHEIN "intentionally" infringed its trademark without authorization and "caused product confusion for its own benefit."

 

Stussy said SHEIN faces liability for trademark infringement and counterfeiting, trademark dilution and unfair competition for selling products with "replicas and near-replicas of the STUSSY trademark." SHEIN used logos "virtually identical to authentic STUSSY logos" on clothing and footwear, but avoided using the word "Stussy" on its product listings in order to hide its counterfeiting.

 


Unlike other trademark cases, according to Stussy, the damage caused by SHEIN's actions is more serious due to the great value of its brand trademark. The brand claims that the STUSSY mark "represents and symbolizes the good reputation of the product and the valuable goodwill among the public throughout the world" and is "more valuable" than ordinary marks.

 

Stussy's business model is to create a limited and exclusive brand. Therefore, Stussy believes that SHEIN "tried to fill the market for Stussy products by imitating products." As a result, Stussy "suffered significant damages and injuries," including lost profits and other losses. Considering that SHEIN "obtained illegal profits from the above-mentioned conduct," Stussy hopes to receive the profits from SHEIN's sales of these products.

 


Additionally, Stussy is seeking injunctive relief to temporarily and permanently prohibit SHEIN from infringing or diluting its trademarks.

 

It is understood that Stussy was founded in 1980 and mainly sells skateboards, surfing, streetwear and accessories. Due to its limited sales strategy, counterfeits are inevitable. Since 2000, Stussy has been filing trademark-related lawsuits. SHEIN representatives did not immediately respond to Stussy's lawsuit .

 

However, SHEIN has also been involved in copyright infringement for a long time. In June and July last year, due to the similarity of their products, Dr. Martens, the brand of Martin boots, Kikay, the brand of earrings, and Elexiay, the fashion brand, questioned SHEIN's infringement and publicly defended their rights. After the incident fermented, SHEIN also removed some related products from the shelves.
