Since September, a large number of Amazon sellers have been convicted of brand abuse. What is frustrating is that many sellers have tried various methods to appeal but to no avail.
Seller brand abuse appeal successful
Recently, good news came. A seller posted on an industry forum that his appeal against brand abuse was finally successful.
Amazon seller Zoie said that on September 12 this year, she suddenly found that her store brand function was revoked . She checked her email case , performance notification and br page at the time , but did not receive any notification.
After Zoie opened a case and asked Amazon customer service , Amazon customer service said that the seller was judged to be brand abuse and needed to file an appeal. But strangely, her brand abuse was different from that of other sellers. There was no appeal entry or reminder. Amazon customer service only asked Zoie to submit all the appeal information to him, and then the customer service would help forward it to the relevant team of Amazon.
To get to the bottom of what was going on, Zoie examined the factors that may have led to brand abuse .
The first is that there were reports of copycat sales on the Canadian site, so it is possible that Amazon determined that it was brand abuse because of the reports .
The second is the qualification of the trademark attorney. Zoie checked whether her trademark attorney was qualified and whether there were any disputes. After checking, it was found that the qualification of the trademark attorney was normal.
Third, the brand was associated with two stores. The brand was initially associated with store A, but store A went down, so Zoie reassociated the brand with the same name with store B. After verification, Zoie believes that in addition to the lawyer factor, reporting copycat sales and brand association with multiple stores may also be the reasons for brand abuse .
So, Zoie submitted the LOA , brand receipt , lawyer qualification materials , product packaging with barcode , purchase contract and POA for the first time with the mentality of giving it a try . Zoie did not mention her situation of copycat sales in her appeal, but only wrote that her brand was wrongly abused and hoped to be restored as soon as possible .
Zoie waited for more than a month after submitting the appeal, and Amazon responded that it had determined that the brand was abused and the appeal failed.
Although the appeal failed, Amazon provided a solution, reminding Zoie that if he wants to solve the problem of brand abuse , he needs to check whether all accounts under the brand are normal and whether there are any accounts that have been closed. If so, please appeal back to the account first.
So Zoie contacted FWS to issue a purchase contract in both Chinese and English . Unexpectedly, her appeal was approved a week after she submitted the documents.
A large number of brands abuse automatic recovery
Last month, sellers reported that a large number of brand abuses were automatically restored.
One seller said that he did not file an appeal and the brand was automatically restored. He was already preparing to change his attorney and file a complaint with the service provider, but now it has been automatically restored before he has had time to do so.
In October, a large number of brands abused automatic recovery. The reason was not only that the sellers successfully appealed, changed lawyers or the service providers had effective operations, but more like Amazon relaxed its review requirements.
However, among these restored removed brands, not all accounts have restored their brand functions. Some accounts are still in a state of brand abuse , with multiple functions such as user management permissions restricted , and authorization cannot be revoked.
One seller said that his account was scanned in September, and the brand abuse problem broke out. It was automatically restored last month. But a few days later, his account was scanned again. What's worse is that the appeal was rejected, and it showed that the rejected brand was still unfamiliar.
How to solve the problem of sellers being convicted of brand abuse?
Since September this year , the problem of brand abuse on the Amazon platform has become increasingly serious, and both new and old brands are not immune. There are even sellers with multiple accounts that have been convicted of brand abuse . The biggest headache for sellers is often that after being judged by Amazon to have abused their brand , new brands cannot be registered, which seriously affects the normal operation of the store.
The sellers affected have made continuous appeals. Although they have comprehensive information to prove that they are the brand owners, their appeals have repeatedly failed. Many sellers have no choice but to accept the defeat.
After some sellers have failed to file multiple complaints against brand abuse, they can only choose to seek help from service providers. However, a service provider with a relatively high reputation in the industry directly quoted 6,000 yuan, while Taobao quoted 2,500 yuan, which is a huge difference in the price .
Moreover, many service providers of related businesses do not have clear success rate replies , and the appeal cycle is long . Some do not accept the appeal, and most IP accelerators do not accept the appeal. It is generally recommended to change the label through them. The service provider cannot really solve the problem, and the sellers can be cut off if they are not careful.
Generally speaking, if a seller abuses their brand, you must conduct a self-examination to find out the most likely cause of the abuse before filing a complaint .
Sellers can find out the reasons for being found guilty of brand abuse based on the following aspects:
1. Check all sites associated with the account to see if any one site has violated the rules.
2. Check whether the store has any infringement, fraud or other illegal information that has not been handled in a timely manner.
3. Check whether the brand is associated with too many stores. Because if a brand authorizes many stores, or a store has many brands, then if one brand has a problem, all brands in the store may be at risk.
After the seller confirms the reason for being convicted of brand abuse, the next step is to open a case and file an appeal in a timely manner.
When making an appeal, be sure to prepare detailed appeal materials, including email address, brand name, case number, product acceptance notice and registration number, link to the brand's official website, real photos of products that clearly display the logo, real purchase VAT invoice, store business license and screenshots of the store homepage , etc. Finally, submit all the materials together for the appeal and wait for notification of the result.
