In May this year , the sales of this toy were 5173. In August last year, the sales reached 15239. The editor searched Google Trends and found that the popularity of " Robo Fish " has increased significantly.

The editor learned that the biggest feature of this toy fish is that it changes color when activated in water and can even dive 6 feet . One seller said, "This is a cool toy, it is very realistic in water, and bathing becomes fun!"

 

Overturned! Hidden risk of infringement

 

But this toy that has captured the hearts of thousands of foreign "mythical beasts" has been in constant turmoil recently, and some stores have failed one after another...

 

On June 2, the brand owner Zuru (Singapore) Pte. Ltd filed an infringement lawsuit, mainly involving trademark infringement . Currently, the case has been represented by the law firm DENTONS US LLP, and its Robo Fish may also be involved.

 

The editor learned that most of the stores that overturned used the keyword " Robo Fish ". According to public court documents, ROBO FISH and ROBO ALIVE are both word trademarks. As early as 2013, ROBO FISH had registered a US trademark for 28 categories of toys and games.

 

In fact, last year, a seller was hit hard by Robo Fish due to copyright infringement . One seller had his funds frozen for a few hundred dollars the first time, and before he could recover, the second freeze came and he was sued for 1 million dollars!

 

Experienced sellers must be familiar with this product and this brand. Using trademark words itself carries the risk of infringement. In addition, if the product appearance is highly similar, it is also likely to cross the red line, so sellers should not be careless!

 

As Membership Day approaches, sellers are busy preparing and replenishing stocks, but they must understand the products in detail in advance to avoid unnecessary trouble.
