Recently, some netizens discovered that the works of the famous Australian artist Tank were plagiarized by Temu sellers, and more than one seller used the patterns of Tank's works for sales.



The design , called Complex of Being, is sold as a small canvas print on Tank's website for $275.

 

However, two sellers on Temu have been exposed to use the same design and sell it for less than $7. One of the sellers has sold more than 500 units of the product.

 

It was Tank's friend who first warned him that his work might have been plagiarized. Tank said this had happened before, but he didn't expect it to be so large this time.

 


Tank said that he was very sad to see his work being plagiarized by others, especially when he saw that the other party sold it at such a low price, he felt that his art was insulted.

 

"If you have a good product, it will soon be spotted by others, mass-produced, and finally sold under the trademarks of other brands," Tank said, summarizing his experience.

 

Melinda Martin, CEO of the Australian Local Art Gallery , said that Tank's situation is not uncommon. It is one of the biggest challenges facing the contemporary art world and there has been no effective solution for a long time.

 

Linda Martin believes that "the frequent occurrence of such incidents means that creativity is not valued, which is the most critical reason. If people cannot make a living without creativity, this is a very sad indictment of contemporary culture."

 

Catherine Giles, a lawyer at the Australian Arts Law Centre , said the centre handles hundreds of copyright infringement cases caused by online platforms every year.

 

"If an artist believes their art has been misappropriated, the first thing they should do is seek legal advice," Giles said.

 

"It depends on what platform you are dealing with. Some platforms have relevant complaint procedures, which is more convenient than taking legal action directly."

 

In response to this situation, Tank said it had contacted the platform, and Temu responded that it would investigate the matter, but did not give a specific time point.
