Recently, according to foreign media reports, an official of the National Labor Relations Board (NLRB) suggested that the landmark victory of Amazon's American union should be supported, which is a major setback for Amazon in its attempt to overturn the results of the union vote.
The cause of the incident can be traced back to April this year, when workers at Amazon's warehouse on Staten Island (called JFK8) voted to establish the first Amazon Union (ALU) in the United States, with more than 2,600 workers participating. This is also the first union in the United States in the history of Amazon, so it is called a milestone victory for the Amazon workers' union.
However, the formation of the union will not be so smooth. Because then in May, Amazon tried to overturn the vote, opposed the formation of the union, and did not recognize the union. It also submitted a document to the NLRB, accusing the Brooklyn office of the federal agency of violating labor laws by appearing to support the union movement. The document contains 25 objections, claiming that labor organizations intimidated workers to vote in their favor.
Amazon's objection set off a 24-day hearing held via Zoom, where Amazon's lawyers, the NLRB and the ALU dissected their actions during the election. The hearing moderator concluded in a document recently that Amazon did not provide any evidence to prove that the union, the government or anyone else acted to influence the election results. The NLRB spokesperson also recommended that the ALU be certified as a bargaining representative.
Foreign media reports show that Amazon must object to the hearing officer's recommendation by September 16, and then a regional director of the NLRB will hear the opinion. The regional director will decide whether to order a new union election or certify the results of the April election, when Amazon will be required to begin contract negotiations with the ALU. The union said in a statement that it is satisfied with the hearing officer's recommendation and hopes to speed up their certification.
In fact, the struggle between Amazon and the workers' union has a long history. It is reported that in the nearly 30 years of Amazon's history, workers have tried to form a union many times, but all ended in failure. Therefore, Amazon has accumulated rich experience in anti-union. In order to prevent warehouses around the world from forming unions, Amazon has invested a lot of energy and money in anti-union.
This is the biggest setback in Amazon's long battle with the union. If Amazon cannot convince the agency to overturn the vote, it will be legally required to negotiate with the union over wages and working conditions at the Staten Island warehouse.
