At the beginning of the new year, infringement incidents still occurred frequently. In January alone, Shenzhen Customs reported 6 intellectual property administrative penalty cases, involving goods with a total value of nearly 600,000 yuan and a total fine of about 87,000 yuan.
According to information disclosed on the Shenzhen Customs website, a Shenzhen company declared to Shekou Customs that it was exporting light bulbs to South Africa. However, after inspection by the customs, it was found that the actual exported goods contained 28,800 boxes of shoe polish with the "KIWI and KIWI bird graphics" logo, with a value of 207,360 yuan. The right holder, SC Johnson & Sons, confirmed that this infringed its exclusive right to use the trademark. For this reason, the customs confiscated the infringing goods and imposed a fine of 31,104 yuan.
Similarly, another company also declared to Shekou Customs that it was exporting light tubes. However, during the inspection, the customs also found other goods, including 85 counterfeit goods of luxury brands such as CHANEL and Dior, with a value of 4,936 yuan. The customs decided to confiscate the infringing goods and impose a fine of 987 yuan on the party concerned.
During another inspection, Shekou Customs also found other goods mixed in with the declared goods, which were 10,000 counterfeit identification cards marked with "POKEMON" with a value of 2,000 yuan. In response, the customs confiscated the infringing goods and fined 300 yuan.
Not only that, Shekou Customs also seized a case of counterfeit electronic products. It is reported that a Guangzhou company declared to the customs to export bottles and other goods to Japan. However, the customs found that other goods were mixed in the batch of goods, including electronic products with brand logos such as HUAWEI, Apple, and OPPO, totaling 1,473 pieces with a value of 241,828 yuan. In this case, the customs confiscated the above-mentioned infringing goods and imposed a fine of 36,274 yuan.
In addition to Shekou Customs, Dapeng Customs recently reported an intellectual property administrative penalty case. It is understood that Dapeng Customs found 12,434 counterfeit briefcases marked with the "DELL" trademark in a batch of handbags shipped to Senegal, with a value of 120,284.03 yuan. Similarly, the customs confiscated the infringing goods and imposed a fine of 18,000 yuan.
Another counterfeiting case was discovered by the Shenzhen Baoan Airport Customs. Customs found 10 overhaul kits and 16 pistons with the "Haima" trademark in a batch of ignition coils, with a total value of 1,708 yuan. In response, the customs confiscated the above goods and imposed a fine of 256 yuan.
From these six cases, we can see that some sellers try to mix infringing products with the declared items to get through customs. However, these methods cannot escape the eyes of customs. For sellers, operating in compliance is the best strategy. Shenzhen Customs Infringement |
