The reports also identify e-commerce platforms and streaming sites that provide illegal IP violations, including but not limited to pirated digital files and counterfeit goods. In the report, Bukalapak and Tokopedia were specifically mentioned as e-commerce platforms in Southeast Asia . Bukalapak, one of Indonesia’s largest B2C e-commerce platforms, was recorded as allowing the sale of counterfeit electronics , clothing , fashion accessories , books , movies , mobile phones , cars and auto parts , industrial products, and pesticides. The report also said that most of the goods on the platform originated from mainland China and their removal system was ineffective due to a lack of deterrence measures and a failure to stop repeat infringers and known counterfeit sellers. Separately, Tokopedia , one of Indonesia’s largest B2C and B2B e-commerce marketplaces, was also included in the list because it allows the sale of a wide range of counterfeit goods, including academic textbooks , clothing , sporting goods , electronics , food and beverages , jewelry , leather goods , watches , cosmetics, and toys. Some issues with Tokopedia were also highlighted in the report , such as allowing ads for “copies” of real brands and onerous documentation requirements. But the reporting process is complex to operate, and the platform also has effective anti-counterfeiting measures to deter repeat infringers. According to the reports , the platforms that responded to the allegations claimed that their anti-counterfeiting policies are designed to prohibit the sale of counterfeit goods and have procedures in place to enable brand owners to notify intellectual property infringements. The platforms also refuted the claim by saying they have taken proactive steps to eliminate infringements and have collaborated with stakeholders including law enforcement agencies , regulators and brand owners on IP issues . However, the above issues have become the crux of the conflict between platforms and IP owners in Southeast Asia, and Indonesia faces the most serious problems. More consumers also expect these platforms to implement corresponding measures to address the increasing number of IP violations . The memorandum of understanding signed in Thailand and the memorandum of understanding proposed in the Philippines some time ago are the beginning of regional dialogue to address the needs of platforms.
