According to the latest announcement released by Canon on April 12, in the first quarter of 2022, Canon reported 48 infringing claims to Amazon using Amazon's "Report a Violation (RAV)" tool. Currently, all infringing products have been removed from the Amazon platform, mainly involving three sites in Canada, Mexico and the United States.
Since June 2018, Canon has removed 3,264 products from Amazon Canada, Mexico, and the United States by reporting infringement claims, which shows how much Canon values infringing products on the Amazon platform.
It is reported that the infringing products are mainly laser toner cartridges from suppliers, who have infringed on multiple patent numbers of Canon in the United States, Canada and Mexico, including: one or more of U.S. Patent No. 8280278, U.S. Patent No. 8630564, U.S. Patent No. 8682215, U.S. Patent No. 8688008, U.S. Patent No. 8676090, U.S. Patent No. 8588646, U.S. Patent No. 9581958; Canadian Patent No. 2635791, Canadian Patent No. 2910527; Mexican Patent No. 308881 and Mexican Patent No. 317598.
E-commerce platforms such as Amazon provide brands with unprecedented growth opportunities, but they also provide the same advantages to brand competitors. Some merchants promote copycat, counterfeit or infringing products on the platforms, seriously infringing the rights and interests of brands.
In recent years, many product infringement cases have occurred in the cross-border e-commerce industry. Major overseas brands and law firms are also further increasing their efforts to protect their rights against brand infringements. At the same time, major cross-border e-commerce platforms are also strengthening their control over infringing products.
Amazon is an e-commerce platform that attaches great importance to brand protection. Once infringement is found, it will remove the product from the shelves or freeze the account. Therefore, in order to avoid infringement, cross-border sellers must pay attention to the following two aspects:
First, when selecting products, you should prevent possible infringement issues in the supply chain. You can look for products that have already applied for trademarks and patents abroad, and then sell them with the authorization of the manufacturer. At the same time, you should also pay attention to the brands that are protected by the four major law firms in the United States, and avoid them. Be sure to regularly check all online products in your store to see if they have been registered by others.
Secondly, when posting a listing, it is recommended to use original pictures and text descriptions. The title of the listing and the keywords in the search terms cannot contain other people’s brand names.
