Amazon finally got into trouble? Sued by two major brands for plagiarism and infringement

Multiple sellers sued, Adidas takes large-scale legal action

 

On February 1, local time in the United States , Adidas , represented by SMG Law Firm , filed a case in the Southern District Court of Florida. The TRO temporary freeze has been approved , and the complaint and freeze notice have been sent to major platforms.

 

The case involved multiple platforms, with a list of 445 defendant sellers . In addition to Amazon, multiple platforms including Wish, Joom, and DHgate were also affected.

 

The plaintiffs in this case are three branches of Adidas: ADIDAS AG, ADIDAS INTERNATIONAL MARKETING, and ADIDAS AMERICA , and the type of lawsuit is trademark infringement .

 

The categories registered by Adidas include US trademark category 9 for glasses and sunglasses ; category 14 for watches, leather, imitations, etc.; category 18 for sports bags, travel bags, backpacks; and category 25 for sportswear products including clothing, shoes, socks, gloves, etc.

Adidas's sniping targets are very wide, involving nearly 500 platform sellers. And the lawsuits against infringement have not stopped, and it is reported that there are more complaints waiting for sellers suspected of infringement.

 

Therefore, sellers who sell related products need to conduct timely self-inspections. The presence of Adidas trademark-related patterns, textual mentions in titles, and similar product styles all pose a risk of infringement.

 

Although infringement is a common topic, the editor still wants to remind sellers that they must pay attention to the infringement risks of word trademarks or pattern trademarks in places where text appears, such as titles, content details or product packaging.

 

Once the product involves infringement risks, remember not to get lucky just because you haven't received any warnings yet. Because big brands like Adidas have long-term rights protection cases online, and sellers are always at risk of being sued.

 

Copying Peak Design backpacks and competing on low prices

 

Peak Design recently publicly accused Amazon of selling a $21 backpack that was highly similar to its $80 Everyday Sling Bag, and made harsh accusations against the e-commerce giant through a 1.5-minute video.

 

Peak Design said this is not the first time allegations have been made against the AmazonBasics brand.

Peak Design pointed out that Amazon has been selling similar products to its brand on its platform at low prices. These products look and function almost the same as Peak Design. What's more, Amazon is trying to snatch Peak Design's sales by offering low prices.

 

Amazon's practice is not just aimed at Peak Design, but also affects the sales of many brands, because this practice not only attracts consumers from brands to the platform, but also makes consumers ignore the uniqueness of the product design itself.

 

The most ironic thing is that Amazon is very strict in cracking down on sellers’ infringements, but the platform itself is plagiarizing.

 

“I think consumers who bought the Peak Design bag instead of the Amazon Basics bag really noticed the design philosophy of our brand,” said Peter Dering, CEO of Peak Design. “We appreciate that they chose us over the low price and understood the idea of ​​our brand.”

 

Peak Design said it could have taken legal action against Amazon, but chose to release the video complaint to give Amazon a heads-up. If no changes are made, Peak Design will take Amazon to court.
