Recently, Eureka Forbes, a well-known Indian multinational home appliance company, filed a rights protection application with the Delhi High Court, applying against well-known e-commerce platforms such as Amazon, Flipkart and Meesho, requiring these platforms to delete all counterfeit product listings.
The Delhi High Court had issued an interim order on August 23 in response to Eureka Forbes's appeal. It is reported that the infringed goods are Aquaguard filters manufactured by the company.
According to Eureka Forbes in its application, there are two types of counterfeit products being sold on these platforms: the first is kits that claim to be their original Aquaguard products but are completely counterfeit in nature; the second is that certain brands on the platform use packaging and artwork similar to the company's brands Aquguard, Aquas Filter and Active Cub Maxx, thereby misleading consumers. Amazon, Flipkart and Meesho did not comment on the matter. However, according to an e-commerce executive, almost all platforms have complied with the court order and have now removed the listings of counterfeit products.
The executive, who did not want to be named, said that as a platform, they cannot judge the authenticity of the products sold on the platform unless consumers, brands or relevant departments bring it to their attention.
A spokesperson for Eureka Forbes said the Delhi High Court order is a step forward for the health safety of common citizens in India.
It is reported that Eureka Forbes was founded in 1982 and is headquartered in Mumbai. The company mainly produces water purification equipment, vacuum cleaners, air purification systems and home security products.
The company has its own brand store on Amazon, mainly selling water purifiers, air purifiers and vacuum cleaners. Most of the products have ratings between three and a half to four and a half stars. For the infringing Aquaguard products, the ratings are between three and a half stars. The highest rated one is the Eureka Forbes Aeroguard AP 500, which is made in China.
