Popular toys are sued crazily! Multiple platform accounts are affected and the seller’s 2 million funds are frozen

Popular toys that are all the rage on the internet have started to get sued crazily, so sellers on multiple platforms like Amazon and AliExpress should pay attention.

Since last year, the educational toy brand Foxmind has become popular all over the Internet, and many sellers have set their sights on this piece of fat meat, hoping to take advantage of the popularity to get a piece of the pie. However, recently, Foxmind, a popular toy, launched a rights protection lawsuit, and the case was represented by EPS Law Firm.

Case Information

Case Number: 21-cv-5143

Time of prosecution: Unknown

Freezing time: around June 15, 2021

Plaintiff brand: Pop it

Plaintiff: FoxMind Canada Enterprises Ltd.

Law firm: EPS

Sellers from Amazon and DHgate said that the freezing time was around June 15, and the case filed by Foxmind this time was probably due to one of its products called "Pop It" .

"Pop It" is an educational toy made of edible silicone. It is not only for children, but also for adults to relieve stress. In fact, Foxmind products have been popular in the market for a few years, but the real explosion started with the emergence of various imitations on various e-commerce platforms.

The editor learned that Foxmind's direction of rights protection this time is likely to be appearance and trademark . Foxmind has registered the "Pop It" word trademark, and the appearance is likely to have registered square, circular, petal and heart shapes.

Therefore, sellers of toys should be careful not to use the appearance patents and words that Foxmind has registered. In particular, they should not use the word "Pop It" in the listing details page , otherwise they will face great infringement risks.

In addition, the editor would like to remind everyone that even if "POP" and "IT" are used separately, it is an infringement, so don't try it lightly with a fluke mentality.

It is understood that on multiple platforms such as Alibaba and Amazon , the relevant products are still on sale, and there are quite a few sellers selling them. However, sellers on platforms such as Amazon and DHgate have received notifications of account freezes, and some sellers have even had more than 2 million yuan of funds frozen .

Foxmind's rights protection is fierce this time , and the number of products suspected of infringement is large, and many platforms are involved. Sellers should immediately conduct self-inspections, delete and remove products in a timely manner, withdraw cash as soon as possible, and do not put themselves in danger.
