Recently, the editor learned from the official Amazon seller forum that a seller was seeking help because his account was blocked.

 

The seller Howard_Cool said that he did not infringe any rights, but received a direct notification email from Amazon that his account was suspended. Currently, Howard_Cool's account is in good condition and has not received any intellectual property complaints.

 

Subsequently, Amazon official Collin_Amazon responded to the seller, saying that Howard_Cool needed to submit proof that all products were not infringing. Sellers are requested to conduct a complete investigation of their inventory and consult an intellectual property legal advisor to better understand why they received the infringement notice.

 

In addition, Collin_Amazon emphasizes that the authenticity of the product can be proved by submitting the following materials:

 

A. Invoice proving the authenticity of the product (the seller can remove the pricing information)

 

B. Order number to prove the authenticity of the product

 

C. Letter of authorization from the rights owner (not a forwarded email)

 

D. A court order finding that the seller’s products do not infringe the claimed intellectual property rights or that the claimed intellectual property rights are invalid and unenforceable

 

What is ridiculous is that Howard_Cool said that his product was deleted by Amazon before it was sold, so there was no product produced and naturally no invoice. The seller provided Amazon staff with a detailed product listing and emphasized that the product did not infringe and was independently produced by the seller's factory.

 

Amazon official staff found some suspected brand names, such as "Pirates of the Caribbean" and "Shadow of War" in the listings submitted by sellers while investigating , and emphasized that any product listed on Amazon means that the seller intends to sell this product. If this product is an infringing product, it may cause the account to be affected.

 

Howard_Cool was confused and thought that the two words were common words. He believed that there were indeed Caribbean pirates in reality, and he just combined these pirates with mouse pads. Later, the seller found out in a brand investigation that the word had indeed been registered by someone else. While admitting to infringing intellectual property rights, the seller also said that he felt wronged. He believed that Amazon could notify the seller instead of directly blocking the account, after all, he was undoubtedly infringing.

 

The editor would like to remind sellers that the Amazon platform is different from domestic e-commerce platforms and attaches more importance to the protection of intellectual property rights. When some domestic platform sellers resell on Amazon, they still use the old sales model and add a large number of nouns and modifiers in the product listing to expand the search coverage area. However, this practice may lead to infringement of intellectual property rights if not handled with care, and eventually be blocked by Amazon. Sellers must read Amazon's sales rules carefully to avoid similar situations.
